Ol' Dirty Bastard on the Mend

Hip hop star Ol' Dirty Bastard appeared in Los Angeles Superior Court on Thursday with a representative from the Impact House Drug Treatment Facility to request that the troubled rapper enter the second phase of his rehabilitation program. Ol' D.B., whose real name is Russell Jones, was sentenced to serve 180 days at the facility after pleading no contest to violating his probation in March. The judge agreed to the request since Jones' progress was favorable. Ol' Dirty will now be allowed to leave the Pasadena, California facility on 12 hour passes to do fellowship work. He is scheduled to appear back in court on December 20th for another progress report. In related news, Wu-Tang Clan will release their third opus, The W, on November 21st. Ol' Dirty Bastard is expected to show up on several tracks.

Wyclef & Clive Davis Form Strategic Alliance

Clive Davis, CEO and founder of J Records, has signed Wyclef Jean to a joint venture deal. Under the agreement, Wyclef will sign and produce talent for his newly formed label, Clef Records, while J Records will handle sales, promotion, and marketing aspects for Wyclef's label. Davis said in press release, "Wyclef is one of the premier creative talents of our time. He is also one of the few artist who can be a great entrepreneur as well, sensing the cutting edge and the outer frontiers of music and knowing which discovery can become a lasting star. I'm really thrilled to be his partner, and I know we will continue to share great success together."

Davis and Wyclef previously worked together when Davis was the CEO of Arista Records. Wyclef wrote "Maria, Maria" from Carlos Santana's album Supernatural and "My Love is Your Love," the title track for Whitney Houston's latest release. Both songs were chart-topping singles for Arista's multi-platinum selling artists.

Wyclef released his sophomore solo album, Ecleftic: 2 Sides II a Book, in August.   Wyclef said about the agreement, "I feel honored and privileged that Clive Davis chose me as a musical partner to enter into the new millennium."

Xzibit & Eminem Set for "Anger Management" Classes

Limp Bizkit, Eminem, Papa Roach, and Xzibit will kick off their "Anger Management Tour" on October 19th in East Rutherford, New Jersey at the Continental Airlines Arena. The tour will include stops in Chicago, St. Louis, Minneapolis, and Canada. DMX is also scheduled to appear on several of the dates. In related news, Xzibit is scheduled to release his latest album, the Restless LP, on December 12th. The album will include production by Dr.Dre, DJ Quik, Battlecat, Rockwilder, and Mel-man. Snoop, Eminem, Nate Dogg, and Tha Eastsidaz are also scheduled to collaborate with Xzibit on several tracks. The Restless LP will be executive produced by Dr. Dre. Sade Makes Comeback at the MOBO Awards

The Master Card MOBO Awards will be held on October 4th in London's Alexandra Place. The awards ceremony will be hosted by Lisa "Left-Eye" Lopes of TLC and by MTV VJ Trevor Nelson. Arista Records C.E.O. Antonio "L.A." Reid will receive an outstanding achievement award while UK reggae legends ASWAD will receive the coveted MOBO Outstanding Contribution to Black Music Award. The MOBO Awards will also mark the television comeback of sultry soulstress Sade and end her six-year hiatus. Toni Braxton has also been confirmed to perform at the event while Angie Stone will sing a special remix of her hit "No More Rain" with rising UK garage star Wookie. Donell Jones, Sisqo, Gabrielle, and Jamelia are also among the artist scheduled to perform. The awards will be given in 18 categories highlighting achievements in hip hop, jazz, garage, R&B, world music, gospel, and reggae. Suge Knight Establishes Prisoner Appeal Fund

Death Row Records incarcerated CEO Suge Knight wants to help out inmates wrongfully entangled in the legal system. With the release of the forthcoming Death Row compilation, Too Gangsta for Radio, proceeds from the album's sales will be set aside for a prisoner appeal fund. Advertisements running with the album include a press release that reads:

Proceeds from the new Death Row Records compilation album, "Too Gangsta for Radio" will be set-aside for a special cause the Death Row Prisoner Appeal Fund. Although many people are rightfully incarcerated, this fund will provide some hope for people caught within the American Criminal justice system.

Death Row Records and its founder/CEO Suge Knight will make available funding each year to allow one person (CHILD MOLESTERS AND SNITCHES NEED NOT APPLY) within the Federal system and one person within the State system to mount an appeal, receive help in obtaining the services of and payments for an attorney and a support system to represent his or her case to an Appeals Board.

Death Row is forming a special committee to review cases and will make the final decision on Death Row Prisoner Appeal Fund Applications.

Puffy Settles Dispute Over "I'll Be Missing You"

Sean "Puffy" Combs settled a lawsuit this week in federal court brought by music publisher Albert E. Brumley & Sons. The lawsuit stemmed from Puffy using part of the gospel song "I'll Fly Away" for his 1997 tribute to slain rapper The Notorious B.I.G., "I'll Be Missing You." According to the suit, "I'll Be Missing You," uses eight words from Brumley's 1929 hymn. The song also featured 112 and Faith Evans and was penned by rapper Sauce Money. It also sampled Sting's "Every Breath You Take." "I'll Be Missing You" sold over 11 million copies. Based on the basic rate for music publishing royalties, the publishers would have gotten more than $800,000 from sales alone. The terms of the settlement, however, were not disclosed.

Whitney Houston Charged

Hawaiian prosecutors are retracting their initial statements and are now charging pop diva Whitney Houston with possession of marijuana that an airport employee seized from Houston's bag in January after it allegedly contained 15.2 grams of marijuana. Since airport security doesn't have the authority to detain people, the pop diva was not arrested. She then left the bag and boarded a flight to San Francisco before police arrived. Deputy Prosecutor Mel Fujino said that his office will now charge Houston with thirddegree promotion of a detrimental drug. The charge is punishable by up to 30 days in jail and a $1,000 fine. Prosecutors will give Houston until her arraignment date, October 26th, to voluntarily turn herself in. If Houston doesn't appear in court, a warrant will be issued for her arrest. Deputy Prosecutor Charlene Iboshi told the Hawaii Tribune-Herald, "If [the judge] grants it, then it would be put in the state warrant system, and then if she comes back in the state, she could be arrested. For petty misdemeanors we do not extradite."

Vanessa Williams Sings "A Christmas Carol"

R&B singer and former Miss America Vanessa Williams has been cast in VH-1's adaptation of the holiday classic, A Christmas Carol. Williams will star as Ebony, a former member of a girl group who is also a female version of Ebenezer Scrooge. Kathy Griffin has been cast as the "Ghost of Christmas Past," while the remaining talent is still being sought. Jeff Gaspin, VH1 executive VP of programming and production, told The Hollywood Reporter, "It's done in tongue in cheek with a funny script but very much is taken from the original story. It's very true in terms of story structure to the original Dickens classic, with the exception of a clever twist with the Ghost of Christmas Future. There's a lot of attitude in the script." He also said that Williams' character is based on several real life divas. She will also perform several songs in the movie, which is scheduled to air in December. The movie will begin filming next week in Montreal, Canada.

Michael Jackson Tops Hall of Fame Nominee List

Michael Jackson and Paul Simon are the leading nominees for the 16th Annual Rock and Roll Hall of Fame. Both artists were previously elected into the Hall of Fame for their group endeavors; Simon in 1990 as part of the folk duo Simon and Garfunkel and Jackson in 1997 alongside his brothers, the Jackson 5. The 16 other artists nominated include Ritchie Valens ("La Bamba"), Queen ("Another One Bites the Dust"), and soul singer Solomon Burke. Artists are eligible to be awarded the honor 25 years after the release of their first recording. The list of nominees will be sent out to more than 1,000 voting members made up of artists, producers, journalists, and music industry executives. Will Smith Inspires Children's Novel

The lyrics to Will Smith's 1997 hit, "Just the Two of Us," will be used to pen a children's book by the same name. The book will follow the relationship of a father and son through different phases of the child's life as he grows from a baby to a mature adult under the tutelage of his father. The 32-page picture book will be illustrated by Kadir Nelson. Nelson's work has also appeared in Brothers of the Knight, a book written by actress Debbie Allen. Just the Two of Us will be released by Scholastic Press in April 2001. Smith's song was featured on his first solo album, Big Willie Style. The song sampled the R&B classic "Just the Two of Us" by soul legend Bill Withers and saxophonist Grover Washington, Jr. When Smith recorded his song, it was a dedication to his son Tre. In related news, his latest film, The Legend of Bagger Vance, will hit theatres on November 3rd. The film also stars Matt Damon and Jack Lemmon.

MP3.com Hit With Another Lawsuit

The troubles for MP3.com keep mounting as Zomba Recording Company and Zomba Music Publishing are the latest music companies to file lawsuits against the file sharing website. According to a press release, Zomba claims that MP3.com "has adopted a blatant strategy of attempting to unlawfully build a business by misappropriating us and our artists' and writers' goodwill, recordings, and songs." Zomba Recording Company owns Jive Records, whose roster includes R. Kelly, Joe, N'Sync, Britney Spears, and the Backstreet Boys.

U.S. District Judge Jed S. Rakoff ruled that MP3.com willfully violated the copyrights of record labels and was ordered to pay the Universal Music Group $118 million, or $25,000 per CD infringed upon. Rakoff said the stiff penalty sent a message to the Internet community to deter copyright infringement. In April, a U.S. Federal Court ruled in favor of the Recording Industry Association of America's (RIAA) lawsuit, which claimed that MP3.com broke copyright laws by creating a database for users to store and access music via the Internet. EMI, Warner, Sony, and BMG settled with MP3.com earlier this year for an estimated $20 million each. Once all the lawsuits are settled, MP3.com could end up paying over $3.6 billion. The file sharing company plans to appeal all the decisions.

Busta Hits the Road

Busta Rhymes has announced that he will be headlining a mini-tour this fall that will hit several universities. The tour will kick off on September 20th in Edinboro, Pennsylvania at Edinboro University and wrap up on October 28th in Greensboro, North Carolina. The tour also includes stops in Florida, Connecticut, Louisiana, and Georgia. Busta was originally scheduled to perform on the "Rhyme & Reason 2000" tour with Rage Against The Machine and the Beastie Boys. That tour was recently cancelled due to scheduling conflicts and because Beastie Boy member Mike D was undergoing physical therapy after undergoing surgery for injuries resulting from a bicycle accident. Selma, Alabama Elects Its First Black Mayor

James Perkins became the first black mayor of Selma, Alabama on Tuesday. The 47-year-old Perkins ousted Mayor Joe Smitherman, a former segregationist who was seeking his 10th straight term in the non-partisan runoff. The 70-year-old Smitherman once publicly referred to Martin Luther King, Jr. as "Martin Luther Coon" and led the assault on marchers back in 1965. Selma marked the turning point of the Civil Rights era when demonstrators were brutality beaten in 1965 by police as they attempted to complete a 50 mile March from Montgomery, Alabama to Selma. The march was in protest for African-Americans to gain voting rights in the South without discriminatory practices and intimidation that previously kept them away from the polls. It was Perkins' third attempt to take Smitherman out of office. In the mayoral election on August 22nd, Smitherman did not get the 50 percent needed to avoid a runoff.

During the campaign, Smitherman had warned that Selma would have an all-black government and business would leave if Perkins were elected. After the election, he said, "Mr. Perkins ran a good race and I respect him. I will not contest the result."

Perkins said during his victory speech, "Many have said that this campaign was about black and white, but I stand here to tell you that ain't so. This campaign has been about faith and fear. Faith won this campaign."

Marvin Gaye's Family to Secure Bond Deal

The estate of R&B icon Marvin Gaye is expected to sign an eight-figure celebrity bond deal with bond salesman David Pullman later this week. The deal will mark the first time that an estate has borrowed money against the royalties generated by a deceased singer's songs. The bonds secure royalties from artists' future recordings to pay off their debts. Pullman has also secured bond deals for such artist as David Bowie, James Brown, Ashford & Simpson, and the Isley Brothers. Gaye's three children, Marvin III, Frankie, and Nona will divide the proceeds from the bonds.

Gaye contributed to the classic Motown sound of the 60s and is known for such hits as "I Heard It Through the Grapevine," "What's Going On," "Let's Get It On," and "Sexual Healing." An album featuring performances from his last concert on April 1983 in Indianapolis was released earlier this year entitled, The Final Concert. Gaye was shot and killed in 1984 after an altercation with his father.

Elderly Get Tricked into Slave Benefits Scam

According to the Associated Press, hoax letters have been mailed out to elderly African-Americans across the South over the past three weeks, telling them they may be eligible for $5,000 in slave repartations or Social Security reimbursements.

The letters, which include requests for Social Security numbers, are apparently part of a scam aimed at stealing people's identities and running up credit bills under their names. Mark Pryor, Arkansas Attorney General, said, "What they are really trying to get is personal information from seniors." The slave reparation letter, written in all capital letters on plain white paper, is targeted at those born "prior to the year of 1928 and of the black ethnic race." It suggests that the federal government is seeking individuals entitled to payments under a supposed "Slave Reparation Act." The other letter is targeted at people born between 1917 and 1926. It says these "notch babies" are due $5,000 a piece because of a glitch in Social Security collections.

Pryor also said that people born between those years may indeed be getting less Social Security money because of the way the retirement program was set up, but Congress has not been able to fix the error. The letter plays on those congressional attempts, saying: "There is a measure attempting to be passed, but you must be registered in order to receive it."

Both letters, which were also circulated in black churches and senior centers, instruct people to submit their name, address, telephone number, and Social Security number to the "National Victims Registrar" in Washington. The payments would be added to future government benefits checks or issued in a lump sum, the letters promise. With the requested information, scam artists can assume others' identities.

Pryor concluded that he knows of no case yet where someone's identity had been stolen in the scam, but that people who have submitted their information should contact the Social Security Administration and check their credit reports.

Dre and Metallica Want Napster Banned at Schools

Dr. Dre and rock group Metallica are putting more pressure on Napster by asking several prestigious universities to cut off access to the MP3 file sharing company. A letter sent to the schools by attorney Howard E. King of the Los Angeles, California-based law firm King, Purtich, Holmes, Paterno, & Berliner, which represents both artists, read, "The universities have "a moral, ethical and legal obligation" to show they are not enabling "the theft of intellectual property. Some colleges have already decided it is not morally, ethically or legally right for university facilities to be used for wholesale copyright infringement." King also identified some of the major universities that have not banned Napster. The schools who received letters are Boston University, Columbia, the Georgia Institute of Technology, Harvard, MIT, Princeton, Stanford, UC Berkeley, UCLA, the University of Michigan, and the University of Virginia.

Dr. Dre and Metallica have been two of the strongest opponents of Napster. The company enables users to trade music files called MP3s without any royalties being given to the artist. Dre and Metallica filed a lawsuit in April against the company, which is still pending. The lawsuit also named Yale University, the University of Indiana, and the University of Southern California as co-defendants, but their names were dropped from the suit when they agreed to block students' access.

King also said, "The lawsuit still gives us the right to add other universities, but the letter itself wasn't written to be a threat Ņ we did not want to couch it in those terms." The letter states: "Even without the threat of litigation from artists and other copyright owners, I believe that you can easily recognize the irony of encouraging your students to matriculate in the creative arts, while engaging in behavior which, if unchecked, will make it impossible for those students to earn an income from their future creative efforts."

None of the schools that were issued the letter have agreed to the request to block Napster, although King has asked them to respond by Friday.

Death Row to Release Snoop Album

Death Row Records has announced that they will release an album of previously unreleased songs by label escapee Snoop Dogg. The album is entitled Dead Man Walkin' and will hit stores on Halloween. It includes tracks with Daz, Kurupt, Lil Malik, and Swoop G. The first single is called "Head Doctor" and details a menage a trois encounter after leaving a nightclub. The song is expected to hit radio stations by October 17th. The album will be executive produced by Death Row's incarcerated CEO Suge Knight.

In related news, Snoop will release his feature film Bones in October. Snoop plays a 20-year-old ghost who comes back to haunt his killers. The vivacious Pam Grier will play his girlfriend in the film, which is directed by Ernest Dickerson. Dickerson also directed Tupac in the film Juice. Snoop will also release an album of all new material, entitled Last Meal, on December 5th via No Limit Records.

Mary J. Blige to Serenade the Million Family March

Mary J. Blige and Macy Gray are among the artists confirmed to perform at the Million Family March on October 16th in Washington, DC. The event is being organized by Nation of Islam leader Louis Farrakhan and will also mark the fifth anniversary of the Million Man March. Def Jam CEO Russell Simmons is also leading an effort to bring the hip hop community to the march. Simmons said in a press release, "I believe this march will have a dramatic effect on race relations. It's a march about the human family, rising above color and religion, symbols, and creed." Simmons also stated that he gathered several entertainers together to create public service announcements "to further promote the spirit of the march and encourage attendance." The list of artists includes dead prez, Isaac Hayes, DMX, and Snoop Dogg. Kelly Price and Erykah Badu are also scheduled to perform at the rally. Burger King Has Al Sharpton "Flame Broiling" Mad

Rabble-rouser Al Sharpton is threatening to organize a nationwide boycott against the restaurant chain, Burger King. According to Reuters,the pending boycott is in relation to a dispute between Burger King and La-Van Hawkins, a franchise owner of the restaurant chain. According to a press release issued by a spokeswoman for Rev. Sharpton, Hawkins filed a $1.9 billion lawsuit against Burger King in April, saying the restaurant created a ``fiasco'' for him and ''for potential minority entrepreneurs and franchise owners across the country.'' Hawkins said the company had broken a 1996 promise to let him operate restaurants in economically disadvantaged federal empowerment zones across a number of major U.S. cities. Burger King then counter-sued Hawkins, saying he owed it more than $6.5 million in royalties and loans.

Colin Storm, Chief Executive Officer for Burger King said in press statement, "We have tried to settle this dispute in good faith. Our case is based on the simple premise that Mr. Hawkins has not paid his bills to us. Mr. Hawkins and all of our franchises fully understand that they will not be approved for development of additional restaurants if they fail to pay their fees."

Sharpton, who is president of the National Action Network, will hold a press conference outside of a Wall Street area Burger King restaurant later today to outline considerations that Burger King needs to take to avoid a national African-American boycott of the chain. Sharpton's press release also stated that if Burger king doesn't make a "good faith effort" to meet standards set forth by African American leaders, the boycott would officially start during the Congressional Black Caucus in Washington, DC.

Mariah Carey Sued for Copyright Infringement

R&B singer Mariah Carey was hit with a copyright infringement lawsuit on Friday over her hit single "Thank God I Found You," from her 1999 album, Rainbow. The suit was filed by songwriters and producers Seth Swirsky and Warren Campbell in U.S. District Court of the Central District of California. The duošs suit claims that the song borrowed heavily from a song which they wrote, "One of Those Love Songs," from Xscapešs 1998 album, Traces of My Lipstick. Swirsky and Campbellšs suit also claims false designation of origin, reverse passing off, unfair competition, unjust enrichment, demand for accounting, constructive trust, and permanent injunction. Ironically, both albums were released by Columbia Records, while Jermaine Dupri executive produced Traces of My Lipstick and produced tracks for Rainbow. Columbia Records and producer Terry Lewis were also named in the suit.

In related news, Carey is currently filming her first feature film, All That Glitters. She stars as a struggling singer who rises from poverty to superstardom. The film also stars Da Brat and Eric Benet. All That Glitters is directed by Vondie Curtis- Hall and is scheduled to hit theatres next March.

Eminem Gives Deposition in Defamation Suit

Rap star Eminem returned to Macomb circuit court in Michigan yesterday to give a video deposition in the $10 million defamation of character lawsuit filed by his mother. In June, Eminem turned down her offer for a $2 million settlement. Fred Gibson, the attorney representing Eminemšs mother, Debbie Mathers-Briggs, told The Detroit News, "He made it clear that hešd rather pay his attorneys $100,000 and make sure she doesnšt get a dime." The mother of the hip hop star filed a $10 million defamation lawsuit and a $1 million civil lawsuit against the rapper. The lawsuits are based on the rapper's statements in magazines that his mother was addicted to drugs and had a history of suing people. Gibson also stated that Eminem testified that "the drugs she abused were prescription drugs." Gibson conceded that Eminemšs mom did use prescription drugs like Vicatin and Valium during the rapperšs childhood, but didnšt abuse them. Eminemšs sophomore album, The Marshall Mathers LP, has already sold over 5 million copes is currently ranked second on Soundscan.

Spike Lee to Direct Huey P. Newton Biography

Spike Lee has signed on to direct A Huey P. Newton Story for BET Movies. The movie will be based on the life of the co-founder of The Black Panther Party. The television movie will be produced in association with the Public Broadcasting Service and the African Heritage Network. Roger Guenveur Smith will play Newton. Smith also previously created a one-man show about the late Black Panther Party leader. Newton has also appeared in several of Spike's films including He Got Game,Malcolm X, and Get on the Bus. In a related twist, Smith played in the 1995 film Panther as a FBI agent who helped topple the pro-Black organization. Leešs latest feature film Bamboozled, will be released on October 6th. The film stars Damon Wayans, Tommy Davidson, Jada Pinkett Smith, and Savion Glover.

FBI Probe Extortion of Tupac and Eazy- E

According to the website, smokinggun.com, The FBI "extensively investigated" whether the late rappers Tupac Shakur and Eric "Eazy-E" Wright were the victims of death threats and extortion plots hatched by individuals aligned with the militant Jewish Defense League. Details of the federal investigation began weeks after Shakur was murdered in September 1996. The records, many of which were heavily redacted prior to their release, indicate that the FBI probe was classified a "Domestic Terrorism" case because of the JDL’s alleged involvement. One FBI memo notes that the Jewish group "has been the subject of numerous Bureau investigations involving bombings and homicides," including the unsolved 1985 killing of Arab-American activist Alex Odeh.

According to the FBI records, agents in Los Angeles opened a preliminary criminal inquiry on October 17, 1996 after "two independent sources" provided information that JDL figures were "extorting money from various rap music stars via death threats." After six months of this initial inquiry, agents opened a full-blown "field investigation" on April 15, 1997 because, one memo states, there was a "reasonable indication" that "extortionate/criminal activity" was occurring.

On May 18, 1999, the FBI’s "Act of Terrorism" (AOT) investigation was formally closed. In a memo to the National Security division at FBI headquarters in Washington, a Los Angeles agent reported that the matter had been "extensively investigated," but probers were unable to corroborate the "source information" which triggered their criminal inquiry. Representatives for the JDL said that they did have a close tight relationship with Eazy -E and that they offered to provide security for him when he was allegedly threatened by Suge Knight over a recording contract dispute. Eminem Gets Ripped by Senate Commerce Committee

The Senate Commerce Committee fired attacks at the entertainment industry on Wednesday accusing it of marketing violence towards children. The hearing was held following the results of The Federal Trade Commission’s report that movie, music, and video game industries were aggressively marketing adult rated products to kids. The FTC found that 80 percent of R-rated movies, 70 percent of "mature" video games, and all music recordings with labels for "explicit" content, were marketed to children 17 and under.

Lynne Cheney, the wife of Republican vice presidential candidate Dick, specifically attacked Eminem’s lyrics from his song "Kill You" from his multi-platinum album, The Marshall Mathers LP. "This man just won three major awards," said Cheney. "Can you imagine that the entire industry honors this man who makes this despicable material?" Eminem won three MTV Video Music awards last week. The Marshall Mathers LP is currently ranked second on Soundcsan.

Malcolm X Admirer Gets Probation for Stealing Diary

Douglas Henderson, the former court clerk who admitted to stealing the late Black Civil Rights Leader Malcolm X’s diary, was sentenced yesterday to probation and community service. Henderson claimed that he was an admirer of Malcolm X and cited that as his reason for stealing the journal. The incident occurred while he was an employee of the Manhattan Supreme Court.

The theft was brought to light in May of last year when Malcolm X’s children discovered the missing diary at an auction when a dealer offered the diary for sale. The diary, which was on the fallen leader when he was assassinated, was used as incriminatory evidence during the trial against his killers. When the trial had ended, the diary was held in a safe in Manhattan Supreme Court, before it was stolen by Henderson. Henderson claimed he stole the diary in 1991 and only sold it in 1997 because he needed money for rent.

Henderson apologized to Malcolm X’s family in court as he plead for leniency. He was also fined $5,000. Henderson could have received up to seven years in prison. The diary is set to be rightfully bestowed to Malcolm X’s children after the sentencing of Henderson.

Darryl Strawberry

Baseball slugger Darryl Strawberry was released from jail and was sentenced to two years of house arrest after being arrested on Monday for driving while impaired and leaving the scene of an accident. Strawberry will not be forced to wear an electronic monitor, but can only travel to and from work, medical appointments, probation meetings, and urine tests. If Strawberry maintains good behavior for a year, the court may put him back on regular probation for the second year of his sentence. Judge Florence Foster said, "This was the best way to get him out of jail immediately and to let him start on the road to recovery."

Strawberry was arrested on Monday for reckless driving and leaving the scene of an accident while driving to see his probation officer. The baseball slugger was accused of hitting a road sign, rear ending an SUV at a red light, and weaving in and out of traffic. No one was hurt in the accident. Sobriety tests reveled that he had been using a prescription anti-insomnia called Ambien. The drug leaves users drowsy for a day or more. Strawberry said about driving after taking the sleeping pill, "I used the wrong judgement. I just blacked out. I didn’t know if I hurt anybody. I feel really bad about that."

The all-star hitter began his career playing for the New York Mets in 1983, subsequently playing for the Los Angeles Dodgers and San Francisco Giants. In April 1999, the baseball star’s career took a turn for the worse when he was arrested for drugs and solicitation charges. Furthermore, Strawberry tested positive for cocaine in January and was subsequently suspended from the New York Yankees and major league baseball for a year. Strawberry also underwent surgery for colon cancer last month and previously underwent surgery in 1998 when he was first diagnosed with the disease. The surgery resulted in the removal of a two and a half-inch tumor from his intestine.

Clive Davis Adopts a Bad Boy

Clive Davis has hired Bad Boy Entertainment vice- president Ron Gillyard as his new senior vice president of black music for J Records. Gillyard will oversee the black music staff while leading the development, marketing, and promotion of J Records’ urban roster. That roster currently includes former Arista Records artists Deborah Cox, Next, Q-Tip, and LFO. Luther Vandross will also release his next album on the label. Gillyard also previously worked at Motown Record and Harrell Entertainment. Former Columbia Records executive Tracy Waples has replaced Gillyard at Bad Boy.

Davis signed a 50/50 joint venture deal in August with BMG Entertainment to form the new label. Davis will serve as chairman/CEO and will be involved in hands on production on future projects. He also named Charles Goldstuck as President/COO of J Records. Goldstuck was the former executive VP/GM at Arista.

Madonna Vents at the Press and Her Fans

Pop star Madonna has become a little irate as of late. She recently expressed to German magazine, Amica, the problems with her annoying fans and the press. "The fans are getting increasingly aggressive," said Madonna. They don’t leave me alone. They ring my doorbell, they order pizzas, they bother my daughter, they stand in front of my car so that we can’t get out of our driveway. They make life impossible."

Madonna also said, "If it were up to me, I wouldn’t give any interviews. I think they are A) boring explaining the umpteenth time what I do and B) I’m not interested in telling the world about my private life."

Madonna recently gave birth to her second child on August 11th. She is currently living in England with her boyfriend, director Guy Ritchie, and her two children, Lourdes and Rocco. The one time material girl and exhibitionist also told the German publication about the overt nudity in the British culture. "My God, you see nothing but naked women in the newspapers here," said Madonna. "I just have not been able to get used to the naked girls on page three." Madonna will release her 13th album, Music, on September 19th.

Santana Rides High at Latin Grammys

The 1st Annual Latin Grammy Awards were held at the Staples Center in Los Angeles, California. The awards were hosted by Gloria Estefan, Jennifer Lopez, Andy Garcia, and Jimmy Smits. They were televised in more than 100 countries. Carlos Santana was honored with three awards including "Record of the Year" and "Best Rock Performance by a Duo or Group" for his collaboration with Mexican rock band Mana on the hit single "Corazon Espinado." Santana also won "Best Pop Instrumental Performance" for his hit "El Farol." He previously won eight Grammys from his multi-platinum album, Supernatural, earlier this year. Colombian pop singer Shakira won "Best Female Pop Vocal Performance" for "Ojos As" and "Best Female Rock Performance" for "Octavo D’a." Marc Anthony won the "Song of the Year Award" for "D’Melo (I Need to Know.)" Anthony was scheduled to appear at the awards, but pulled out on Friday due to complications from his wife’s pregnancy. The Latin Grammys also paid tribute to mambo legend Tito Puente who died in June. Puente also won "Best Tropical Performance" for his last album, Mamo Birdland. MP3.com Ordered to Pay for Copyright Infringement

U.S. District Judge Jed S. Rakoff ruled yesterday that MP3.com, the Internet music file sharing service, willfully violated the copyrights of record labels and was ordered to pay the Universal Music Group $118 million, or $25,000 per CD infringed upon. The number of CDs considered to be infringed upon is estimated at around 5,000. Rakoff said the stiff penalty sent a message to the Internet community to deter copyright infringement. He stated, "Some of the evidence in this case strongly suggests that some companies operating in the area of the Internet may have a misconception that, because their technology is somewhat novel, they are somehow immune from the ordinary applications of laws of the U.S., including copyright law. They need to understand that the law’s domain knows no such limits." Rakoff could have enforced a penalty of $150,000 per CD, but was somewhat lenient because MP3.com acted more responsibly than other companies.

Universal Records filed a copyright infringement lawsuit against MP3.com in U.S. District Court in the Southern District of New York on September 6th. The label was the last major music company to hold out on filing their complaints. In April, a U.S. Federal Court ruled in favor of the Recording Industry Association of America’s (RIAA) lawsuit, which claimed that MP3.com broke copyright laws by creating a database for users to store and access music via the Internet. EMI, Warner, Sony, and BMG settled with MP3.com earlier this year for an estimated $20 million each. Once all the lawsuits are settled, MP3.com could end up paying over $3.6 billion. The file sharing company plans to appeal all the decisions.

Judge Sacks O.J. Simpson’s Suit

O.J. Simpson lost his bid yesterday to halt production of American Tragedy, a mini-series based on his infamous murder trial. The mini-series is based on the book of the same name by Lawrence Schiller and James Willwerth. Simpson claimed that the movie reveals inside secrets of his defense team and violates his attorney-client privilege.

As previously reported, Superior Court Judge David Yaffe refused to issue a restraining order to stop production of the film earlier this month while he read the script to determine if it released information not found in the book. Simpson’s lawsuit named Schiller, Project 95, the company producing the film for CBS, and his former attorney Robert Kardashian. Simpson also claims that he sent letters to his defense team while jurors deliberated his case in 1995 warning that their conversations were privileged. The statement read, "No one is permitted to divulge privileged communication unless and until you receive a written authorization signed by me."

Schiller’s lawyers claimed that Simpson had been threatening to file litigation since the book was published in 1996 but "chose to sleep on his purported rights, waiting until the defendants were in the middle of filming the multi-million dollar television miniseries on a tight production schedule to seek extraordinary injunctive relief." Judge Yaffe agreed with the defense stating, "There’s just no necessity" for an injunction and that film didn’t contain any new information. He also said that Simpson should have initially sued when the book was first published. Simpson was acquitted of killing his ex-wife Nicole Brown Simpson and her friend Ronald Goldman in 1994. He was, however, found guilty in the civil trial and ordered to pay $33.5 million in damages, which he refuses to pay as he stands by his affirmation that he is innocent. American Tragedy will air on November 12th during sweeps week. It will star Ving Rhames, Christopher Plummer, Ron Silver, and Bruno Kirby. Simpson and his lawyers are considering filing an appeal though it is unlikely a decision will be rendered before the show is aired.

Jimmy Jam & Terry Lewis Join Arista Family

Renowned producers Jimmy Jam and Terry Lewis entered their Flyte Tyme Records label into an exclusive three year joint venture deal with Arista Records. Under the terms of the deal, which weren’t disclosed, Arista will handle all of the marketing, promotion, sales, and distribution responsibilities of Flyte Tyme. Jam and Lewis will also produce other Arista artists under the agreement.

Jimmy Jam said, "I have been fortunate to work with my best friend (Terry Lewis) forever. We now begin a new relationship with L.A. Reid, who has a very similar background to Terry and me- he started as a member of a band and then moved to producing, and he’s from the Midwest. I respect L.A. as a music executive who is also a music person." Jam and Lewis first gained fame in the music industry as part of the Minneapolis funk band, The Time. The duo has gone on to produce platinum albums by such artists as Janet Jackson, Boyz II Men, and TLC.

Antonio "L. A." Reid, co-founder of LaFace Records, replaced Clive Davis as president of Arista when his contract ended in May. As reported, he has since signed producers Kevin "She’kspere" Briggs and LaFace Records co-founder Kenneth "Babyface" Edmonds to joint venture deals, also. Reid said, "We’ll work together to identify artists. Jimmy and Terry specialize in rhythm and blues and pop, and they’ve done it more successfully than anyone."

Mary J. Blige Tops Lady of Soul Awards

The sixth annual Soul Train Lady of Soul Awards were held on Saturday September 2nd at the Santa Monica Civic Auditorium in Santa Monica, California. Mary J. Blige, Destiny’s Child, and Angie Stone were this year’s big winners as all three acts took home two awards a piece. Blige received "Best R&B/Soul or Rap Song of the Year " for her hit "All That I Can Say" and "Best R&B/Soul Album of the Year Đ Solo" for her album, Mary. Destiny’s Child took home "Best R&B/Soul Single by Group, Band, or Duo" for their multi-platinum single "Say My Name" and "Best R&B/Soul Album of the Year by Group" for their album The Writing’s on the Wall. Stone’s hit single "No More Rain (In This Cloud)" received awards as the "Best R&B/Soul Single, Solo" as well as "Best R&B/Soul or Rap New Artist, Solo." DMX has been scratched from MTV’s 2000 Video Music Awards for the second year in a row. The decision was made after the rapper failed to appear for dress rehearsals again. He has since been replaced by Nelly, who is currently ranked at number one on Soundscan with his debut album, Country Grammar. Nelly was originally scheduled to perform as the opening act for the Video Music Awards’ pre show. The 2000 Video Music Awards were held last night in New York at Radio City Music Hall. The Video Music Awards also featured performances by Sisqo, Christina Aguilera, Jenifer Lopez, and N’SYNC. Shawn and Marlon Wayans hosted the event.

Mack 10 Takes T- Boz on "The Paper Route"

TLC's Tionne "T-Boz" Watkins and rapper Mack 10 were married last Saturday at a private ceremony outside of Los Angeles, California. Celebrity guests included T-Boz's fellow TLC member Rozonda "Chilli" Thomas and Mack 10's Westside Connection cohorts Ice Cube and W.C. R&B singer Gerald Levert serenaded the happy bride as she walked down the aisle. The wedding party consisted of ten groomsmen and ten bridesmaids. Mack 10's son served as the ring bearer while his daughter was the flower girl. The couple became engaged last New Year's Eve. They are also expecting their first child together in November. Mack 10 previously stated in press statement, "We were homies for a long time, but it wasn't until the taping of TLC's "Unpretty" video that I finally made my feelings known to her. She felt what I felt, so we came together." In related news, Mack 10 is scheduled to release his fourth album, The Paper Route, on September 12th. The first single, "Tight To Def," features his new wife. Other guest performers on the album include the Hot Boys, Too Short, Ice Cube, and W.C.

Clive Davis & BMG Make Amends With J Records

Arista Records founder Clive Davis announced yesterday that he signed a 50/50 joint venture deal with BMG Entertainment to form a new label, J Records. Sources estimate that BMG put at least $170 million into the label. Davis told Reuters, "This is the largest investment made in a joint venture in the history of the record business. This is not a startup. When we open our doors on Monday, we will be a major record label with our own marketing staffs, our own promotion staff. It's unprecedented. And it's a very fulfilling dream."

Davis will serve as chairman/CEO and will be involved in hands on production on future projects. He has named Charles Goldstuck as President/COO of J Records. Goldstuck was the former executive VP/GM at Arista. More J Records staff announcement will be made next week.

Strauss Zelnick, head of BMG Entertainment, said, "We expect 'J Records' will be a powerhouse, an instant major. It will be a full service label, with black, R&B, pop and rock. We don't differentiate by format."

Antonio "L. A." Reid replaced Davis as president of Arista when his contract ended in May. Many insiders called the 67-year-old Davis' leaving a forced retirement. Upon Davis' initial leaving of Arista, many artists planned to jump ship and leave with him. As a sign of good faith, BMG will also allow Davis to executive produce the albums of his former artists Whitney Houston and Carlos Santana. He will also participate in a joint venture with Arista for Monica's forthcoming album. J Records roster will include former Arista Records artists Deborah Cox, Next, Q-Tip, and LFO.

Chris Rock Gets Jerked?

The Academy of Television Arts and Sciences fumbled the ball recently as they left comedian Chris Rock's name off of ballots sent out to Emmy Award voters. HBO's Chris Rock: Bigger and Blacker was nominated for six trophies overall. The comedy special was left off of ballots sent to 120 people voting in the variety, music, or comedy special category. John Leverence, the Academy of Television Arts & Sciences vice president, who administers the voting, said the error was discovered the day after the ballots were sent out and that HBO was notified immediately, along with the 120 or so voters who were contacted by phone. He told Reuters, "There is a fail safe built into any inappropriate tabulation because your vote will only be counted if you make a numerical ranking of all five candidates. If you've only done four, the accounting firm won't count them, and Ernst & Young is providing us with the handful of ballots that fall into that category. We will go back to those voters and give them another ballot because of the Academy error."

Eddie Murphy & Lil Zane Set to Clash

Hip hop star Lil' Zane was recently cast in Eddie Murphy's sequel, Doctor Dolittle 2. Zane is scheduled to play a love interest of one of Murphy's daughters, who were played by Raven ĐSymone and Kyla Pratt in the 1998 original. Steve Carr, director of Next Friday, will be at the helm of this film, which is scheduled to start shooting in the fall and hit theatres next summer. Lil' Zane will also star in the upcoming film Finding Forrester with Sean Connery, F. Murray Abraham, Anna Paquin, and Busta Rhymes. The film is based on an African-American student attending an all white prep school with dreams of becoming a writer. Zane will play a friend of the student. His debut album, Young World: The Future, hits stores today. The album's first single, "Callin' Me," features 112.

Ray Lewis' Fined by NFL

Baltimore Ravens football star Ray Lewis has been fined by the NFL for pleading guilty to obstruction of justice during the highly publicized murder trial which involved two of his friends. The $250-thousnd fine is believed to be the highest fine against a player for an infraction not involving substance abuse. Lewis' agent, Roosevelt Barnes, was upset with the ruling and said that because Lewis copped a plea to a misdemeanor charge, the NFL may need to "check the traffic records and fine everyone who ever ran a red light."

As VIBE Online previously reported, Reginald Oakley and Joseph Sweeting, the friends of the football star, were cleared of all murder charges in June in an Atlanta court. The two were charged in the stabbing deaths of Richard Lollar and Jacinth Baker on January 31st when a fight broke out after a Super Bowl party. Lewis, who was initially charged in the murder case, copped a deal and testified against his friends in return for murder and aggravated assault charges being dropped against him. Lewis plead guilty to a misdemeanor charge of obstruction of justice in return for his testimony about what he saw during the night of the murders. He also received 12 months probation.

Lewis told the courts how Sweeting showed him how he repeatedly stabbed one of the victims during the fight. Lewis quoted Sweeting as saying, "Every time they hit me, I hit them." During the testimony, Lewis used a laser pointer to demonstrate how Sweeting used the knife to stab Lollar.

Lewis also testified that he saw Oakley and a third member of his entourage, Carlos Stafford, fight with Baker. He said, "That was a frantic fight. They (were) really going at it." He also said that Oakley was the aggressor in the fight. He said Oakley punched Baker four or five times in the chest and Stafford kicked him. "Reginald was the aggressor at the time that I was walking up. He was really hostile toward the other two guys. Then one of the victims struck Oakley on the head with a bottle, spurring a fight that quickly escalated to chaos," said Lewis.

Despite his testimony, Lewis turned out to be the only person convicted in the case for obstructing of justice when he told his entourage to keep quiet. The evidence showed that Baker started the brawl when he hit Oakley in the head with a champagne bottle. Also, allegedly no one actually saw the stabbing.

Damon Wayans' Wife Wants Out

Lisa Wayans, the wife of comedian/actor Damon Wayans, filed for divorce today citing irreconcilable differences. According to a petition filed in Los Angeles Superior Court, the couple has been separated since May 21st. She has been living in their Beverly Hills, California home with their four children since their separation, while Damon has been staying in Santa Monica, California. In her lawsuit, Lisa is asking for joint legal and physical custody of their four children, as well as spousal support, and attorney fees. The couple's 16-year marriage began on April 24, 1984. They have two sons, Damon, Jr., 18 and Michael, 15, as well as two daughters, Cara Mia, 13, and Kyla, 9.

In related news, Damon will be starring in the feature film, Bamboozled. The film will also star Tommy Davidson, Savion Glover, Jada Pinkett, and Michael Rapaport. Wayans will star in the film as a black writer brought on to assist an all black television sitcom, which is primarily written by white people. Spike Lee directed Bamboozled, which is expected to hit theatres on October 6th.

Walt Disney Settles "Black Hoe" Dispute

Walt Disney has agreed to pay a $2 million to Judy Goodwin, a former employee, to settle a lawsuit. Goodwin, an African American woman who formerly worked for the Disney owned Los Angeles radio station KLOS FM, filed a racial discrimination lawsuit against the company on August 6, 1999. The lawsuit claimed that a promotion on the station's "Mark & Brian Show" gave away garden tools called "Black Hoes" and violated anti-discrimination laws by airing "racist and sexually degrading" commercial spots that played around the double entendre pronunciation of the word "whore." Goodwin's lawsuit claims that African-American female employees were forced to pack boxes of the "black hoes" and ship them to advertisers. It also states that the station's executives ran the promotion with the "conscious aim and intent of providing racially offensive, sexually charged entertainment for its primarily white male listening audience and advertising clients."

Disney initially vowed to fight the lawsuit saying it would "vigorously defend itself in this litigation." After community outrage, Walt Disney decided to work on solving the complaint and made a public apology and required its radio station's executives to undergo diversity training. Two other African-American female employees have also filed lawsuits against Disney claiming that they were forced to leave their jobs after they complained about the "Black Hoe" advertising campaign. Although, Leslie Childs may accept Disney's $250,000 settlement offer, Carla Woodson has firmly rejected Disney's offer of $750,000. Woodson's hearing will be held on September 28th when the judge will also consider whether to accept Disney's motion to dismiss the lawsuit.

Death Row Marv Set to Replace Snoop

Death Row Records, the seminal gangsta rap label which formally included Dr. Dre and Snoop Dogg on its roster, is receiving flack for "Death Row Marv." "Death Row Marv" is a figure who sits in a realistic electric chair and can be electrocuted. He even goes through body convulsions and snarls in defiance as he undergoes his torture. "Death Row Marv," manufactured by Mc Farlane Toys, is based on the comic book anti-hero and is sold nationally. Death Row Records has been getting wrongfully accused of distributing the self-described "torture toy." Suge Knight, founder of Death Row Records, said, "They're getting us mixed up because of the name and the fact that we introduced gangsta rap to the public." Knight, who is also serving a prison sentence in Mule Creek State Prison near Sacramento, California, also said, "Death Row Marv sounds like a brother. I hear he talks back when the switch is thrown. Maybe we can sign him!"

Eminem's Wife Sues for $10 Million

Eminem is being hit with another lawsuit. The Detroit rapper's soon to be ex-wife Kimberly Mathers, has filed a $10 million suit against the chart-topping superstar. The suit was filed in Macomb County court in Michigan on August 21. Mathers is fighting for sole custody of their four-year-old daughter claiming that Eminem is incapable of caring for their child. Mathers is also claiming a defamation suit stemming from Eminem's Kim-bashing which was brought to the stage in his recent "Up In Smoke" tour. In an apparent lashing out, Eminem dragged an inflatable doll on stage that apparently represented Mathers and proceeded to kick it around. The rapper's lyrics are also reflective of his animosity towards his wife with tracks like "Kim" from his sophomore album The Marshall Mathers LP which depicts a gradual murder of his then wife. According to Mathers, the couple had been unofficially separated since his June 4 arrest after he allegedly hit a man with an unloaded gun. The rapper, in a jealous rage, attacked the man after witnessing his wife kissing him outside of a Michigan bar. In July, the female Mathers reportedly attempted suicide after attending one of her then husband's shows during the "Up In Smoke" tour. Wayans Brothers To Film "Scary Movie II"

The Wayans Brothers horror movie parody Scary Movie has indeed bought the family more success. Scary Movie opened in July and has already grossed over $144.8 million. The film has also become Miramax's most profitable release. During its opening week alone, the movie grossed $42.3 million, making it the biggest opening in history for an R-rated movie and the biggest film by a black director. Miramax is so pleased that they are planning a sequel to the film. Keenan Ivory Wayans will direct the sequel and Shawn and Marlon will write and co-star in the film again. The sequel will also include new characters and take more stabs at a new batch of horror movies. Scary Movie II is expected to begin shooting this fall and will hit theatres some time next year.

Actor Terrence Howard Arrested

Actor Terrence Howard was arrested on Thursday after allegedly grabbing a flight attendant by the arm and pushing her while traveling on a Continental Airlines flight from Toronto, Canada to Cleveland, Ohio. According to the Associated Press, Howard was taking his three-year-old daughter to the bathroom while the "fasten your seatbelt" sign was still on when he was met by the flight attendant and told to go back to his seat. The stewardess claims that's when the actor grabbed her wrist and pushed her. When the plane landed, Howard was arrested, but was released on Friday. Howard's wife, who was also on the flight, denied that the actor touched the woman. An attorney for Howard said, "He's very upset." He also added that while Howard may have made a mistake, it shouldn't be treated as a criminal offense.

Howard, who starred in The Best Man, was in Canada filming All That Glitters. The movie will star Mariah Carey and feature Da Brat and Eric Benet and is expected to be released in March 2001. His current film, Big Momma's House, stars Martin Lawrence and Nia Long.

Jennifer Lopez & Kings of Comedy Tops the Movies

The Cell took top honors this week at the box office, grossing $17.2 million. Jennifer Lopez stars in the film as a child therapist involved in a new technique of mental transferal that allows her to enter the mind of a comatose serial killer in hopes of rescuing a young girl. The hilarious Kings of Comedy placed second with $11.7 million. The film contains live footage from the highly successful comedy tour featuring Steve Harvey, Cedric "The Entertainer," D.L. Hughley, and Bernie Mac. Spike Lee directed the concert footage for the film. The sci-fi film Space Cowboys featuring Clint Eastwood and Tommy Lee Jones placed third and was followed by The Replacements at fourth. Michelle Pfeiffer and Harrison Ford's thriller What Lies Beneath rounded out the top five movies at the box office this week.

Eddie Murphy's comedy, the Nutty Professor II: The Klumps,came in sixth, grossing $6.4 million. Kevin Bacon's suspense thriller Hollow Man placed seventh as Autumn in New York with Richard Gere and Winona Ryder trailed in at eighth. Coyote Ugly took a rest at the ninth spot as Bless the Child closed out this weekend's top ten. Here are the gross figures.
